General Terms and Conditions for the online purchase of tickets and other services.
These General Terms and Conditions apply between the seller as provider and the person who makes a booking or purchase, either personally or through a third party, via the provider’s online shop or via online partners connected with the seller. These terms apply in particular to tickets for the roller track, tickets for the inclined lift at the Toni Seelos ski jump, and, where applicable, other related services or products.

1. Scope
These General Terms and Conditions apply to all online orders and online purchases of tickets and other services via the seller’s online shop. The version of the General Terms and Conditions valid at the time of the respective order shall apply.
Any deviating agreements shall only apply if they have been expressly confirmed in writing by the seller. Conflicting or deviating terms and conditions of the customer shall not apply unless the seller expressly agrees to them.
2. Responsibility of the purchaser
Before completing the order, the purchaser is obliged to carefully read all essential information about the selected ticket or service. This includes, in particular, the scope of service, validity date, conditions of use, any age, size, safety or equipment requirements, as well as information on operation.
The purchaser is responsible for ensuring that the selected service corresponds to their wishes and requirements. The purchaser is also responsible for ensuring that the data provided during the order process is correct and that the information in the order confirmation corresponds to the order.
The order confirmation will be sent electronically only, usually by e-mail.
3. Conclusion of contract
The presentation of tickets and services in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
By completing the online order process, the purchaser submits a binding offer to purchase the selected ticket or service. The contract is concluded only once payment has been successfully completed and the purchaser has received an order or purchase confirmation by e-mail.
The order is not completed and is not valid in particular in the following cases:
The purchaser has not received an order confirmation or confirmation/reference number.
The online payment was cancelled, rejected or could not be completed for technical reasons.
The payment is incorrect, incomplete or the amount has not been successfully debited.
In these cases, any temporarily created order will be automatically cancelled and does not entitle the purchaser to use the service.
4. Tickets, validity and use
Online tickets entitle the holder, depending on the product booked, to use the roller track, the inclined lift at the Toni Seelos ski jump, or any other service expressly described in the online shop.
The tickets are valid exclusively on the calendar day selected during the order process and stated in the order confirmation or on the ticket. Use on another day is not possible unless a rebooking or deviating arrangement has been expressly confirmed by the seller.
After the selected validity date has expired, the ticket automatically loses its validity. Unused, partially used or late-redeemed tickets do not entitle the purchaser to a refund, replacement or extension.
After successful completion of the order, the purchaser receives the ticket, a QR code, barcode, voucher or other digital authorisation by e-mail or via the technical solution provided in the online shop. The ticket must be presented for use either digitally on a smartphone or in printed form.
The purchaser is obliged to store the ticket in such a way that it cannot be used by unauthorised third parties. In the event of loss, transfer, misuse or technical unreadability of the ticket, there is no entitlement to replacement, unless the seller is responsible for the circumstance.
Tickets that have already been validated, redeemed or partially used cannot be used again.
5. Operation, safety and availability
Use of the roller track, the inclined lift and other services is only possible during the published operating hours and while operations are running.
Operations may be restricted, interrupted or discontinued for safety reasons, due to weather conditions, official requirements, technical faults, maintenance work, events, force majeure or other important reasons.
The seller endeavours to provide information on operating hours and restrictions that is as up to date as possible. Short-term changes are reserved.
The purchaser and all users must comply with the safety, conduct and usage instructions displayed on site, as well as with the instructions of the staff. In the event of non-compliance, use may be refused or terminated without entitlement to a refund.
Use of the roller track is only permitted with suitable equipment and in compliance with the applicable safety requirements. The user must adapt their riding behaviour to their own ability, the track conditions, weather and visibility conditions, as well as to other users.
6. Prices and payment
All prices stated in the online shop are, unless otherwise indicated, in euros and include statutory value-added tax.
Payment is made using the payment methods offered in the online shop. The available payment methods may vary depending on technical availability.
The seller uses external payment service providers to process payments. Payment data is processed via the secure payment systems used in each case. Third parties do not have access to complete credit card or payment data unless this is necessary for payment processing.
Any bank, credit card or transaction fees incurred by the payment provider or the purchaser’s payment institution shall be borne by the purchaser, unless these are expressly covered by the seller.
7. Withdrawal, cancellation and refund
The tickets offered in the online shop are date-specific leisure services. They are valid exclusively for the calendar day selected during the order process.
For services related to leisure activities where a specific date or period of performance is contractually provided, there is generally no statutory right of withdrawal.
Cancellation, rebooking or refund of online tickets is therefore generally excluded, unless expressly provided otherwise in the online shop, in the product description or in these General Terms and Conditions.
In the event of illness, injury or other special circumstances, the purchaser may contact the seller. Any goodwill solution remains at the seller’s discretion and does not constitute a legal entitlement.
If the booked service cannot ultimately be provided on the selected validity date for reasons for which the seller is responsible, the purchaser shall receive, at the seller’s discretion, a replacement service, a rebooking option or a refund of the fee paid.
There is in particular no entitlement to a refund if the purchaser does not use the ticket, arrives late, does not meet the usage requirements, disregards safety instructions, or is unable to use the service for reasons within the purchaser’s sphere of responsibility.
8. Changes to taxes, fees and charges
If statutory taxes, fees or charges change after the order has been completed and this results in higher costs for the seller, the seller is entitled to make legally permissible price adjustments. The purchaser will be informed immediately.
9. Warranty and liability
The statutory warranty provisions shall apply.
The seller shall only be liable for damages in accordance with statutory provisions. Liability for slight negligence is excluded to the extent legally permissible, except in the case of personal injury.
The seller shall not be liable for damages resulting from improper use, disregard of safety or conduct rules, failure to follow staff instructions, overestimation of one’s own abilities, unsuitable equipment, or other circumstances attributable to the user.
Use of the roller track is at the user’s own responsibility. In particular, the user must take due care with regard to other persons, track conditions, weather, visibility, speed and their own ability.
10. Data protection
The seller processes personal data exclusively in accordance with statutory provisions and only to the extent necessary for ordering, payment processing, ticket issuance, provision of services, customer service or legal obligations.
Personal data is only passed on to third parties insofar as this is necessary for contract processing, in particular to technical service providers, payment service providers or other partners involved in the processing.
In all other respects, reference is made to the seller’s privacy policy.
11. Miscellaneous provisions
There are no verbal side agreements. Amendments or additions to these General Terms and Conditions must be made in writing to be effective, unless mandatory statutory provisions provide otherwise.
All legal transactions shall be governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules, unless mandatory statutory provisions provide otherwise.
The legally permissible place of jurisdiction shall apply to disputes. Mandatory consumer protection provisions apply in relation to consumers.
Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic purpose of the invalid provision.
All rights and obligations arising from these General Terms and Conditions shall pass to any legal successors of the seller.
